Terms of Service

You must be at least 18 years old and capable of entering into a binding contract to use Blue Kiwi. By using the Service, you confirm that all information you provide is accurate.

Blue Kiwi uses Clerk for account creation and authentication. You agree to:

• Maintain accurate account information
• Keep your login credentials secure
• Be responsible for all activity under your account

We may suspend or terminate accounts at our discretion if we believe you violated these Terms.

You may use Blue Kiwi only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload or generate illegal, harmful, defamatory, or abusive content
• Use AI-generated content to deceive, impersonate, or commit fraud
• Attempt to access Blue Kiwi systems without authorization
• Reverse-engineer, bypass, or manipulate our systems or security
• Interfere with or disrupt the Services

You retain ownership of all images, product details, prompts, and content you upload. By using the Services, you grant Blue Kiwi a non-exclusive, worldwide, royalty-free license to process your content via AI, display it within your account, and provide features such as saving projects, generating slideshows, and scheduling posts.

You confirm you have all rights necessary to upload and use the content you provide. Blue Kiwi is not responsible for copyrighted, unlicensed, or infringing content you upload.

Blue Kiwi uses AI models from OpenAI, Anthropic, and Google. AI-generated outputs may:

• Contain inaccuracies
• Include unsafe, offensive, or NSFW content
• Misrepresent facts or brand messaging
• Fail to meet performance expectations

You agree that AI outputs are not guaranteed to be correct or safe. You are solely responsible for reviewing content before posting or publishing. Blue Kiwi is not liable for damages caused by AI outputs.

You acknowledge that your content may be processed by external AI providers. These providers may handle data according to their own privacy policies, which may include retention or training practices beyond Blue Kiwi's control.

Blue Kiwi may use anonymized or aggregated user content to improve features, templates, AI prompt structures, recommendation systems, and platform performance.

You may opt out at any time by emailing: hello@bluekiwi.ai

When connecting your TikTok account, you authorize Blue Kiwi to access TikTok analytics and performance data, display this data inside your dashboard, and schedule posts upon your instruction.

Blue Kiwi does not store TikTok OAuth tokens, access your TikTok password, or post content without a user-scheduled action. Scheduling a slideshow counts as a user-approved action. You bear full responsibility for all slideshows scheduled through your account.

Pinterest-sourced images shown in Blue Kiwi are for inspiration only. You may not export or publish them. Example slideshows are for educational and creative reference only.

Payments are securely processed by Stripe. By subscribing, you agree to pay the listed fees, allow Stripe to store your billing information, and automatic renewal unless canceled.

We do not store credit card numbers. Subscriptions may be canceled at any time but are not automatically refunded unless required by law.

You may delete your account via Clerk or by contacting us. Upon deletion, projects, images, and content are removed. Minimal metadata is retained for compliance.

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, misuse the platform, or attempt to harm our systems.

All Blue Kiwi software, branding, templates, tutorials, UI/UX, and internal systems are the exclusive property of Blue Kiwi. Users may not copy, resell, or redistribute the platform, create competing services using Blue Kiwi concepts, or misuse trademarks or branding.

We do not guarantee accuracy of AI outputs, complete reliability or uptime, safe or error-free content, or that generated content will convert, perform, or meet user expectations.

To the fullest extent permitted by law, Blue Kiwi is not liable for loss of profits, business interruption, brand damage, copyright claims arising from user content, harm caused by AI-generated material, NSFW or offensive content generated by models, scheduling errors caused by user actions, or damages exceeding what you paid in the last 12 months.

You agree to indemnify and hold Blue Kiwi harmless against claims arising from your content, your use of the Service, copyright or trademark violations, violations of these Terms, and use of AI-generated content.

We may update these Terms at any time. When we do, we will update the "Last Updated" date. Continued use of the Service constitutes acceptance of updated Terms.

These Terms are governed by the laws of the State of Utah, excluding conflicts of law principles. Any dispute must be resolved in Utah state or federal courts.
